These Terms of Service govern your access to and use of PropertyBuddy.ie (the "Platform" or "Service"). By booking a consultation, browsing listings, or using any features provided by PropertyBuddy ("we", "us", or "our"), you agree to be bound legally by these terms. If you do not agree, you must immediately stop using the Platform.

1. Eligibility and Consultation Booking

  • Age Requirement: You must be at least 18 years old to book a consultation or use our services.
  • Jurisdiction: The Platform is designed strictly for use within Ireland and complies with Irish real estate and digital laws.
  • Booking Information: You agree to provide and maintain truthful, accurate, and up-to-date contact details when scheduling a session.
  • Communication Consent: By scheduling, you agree to receive consultation confirmations, links, and follow-up communications.

2. Platform Usage and Acceptable Conduct

PropertyBuddy.ie is a digital venue facilitating interactions between landlords, property managers, agents, tenants, and buyers. You agree not to use the platform or consultation service to:

  • Violate Laws: Engage in any behavior that breaches Irish or EU laws, including consumer protection and data privacy.
  • Discriminate: Violate the Equal Status Acts 2000–2020 or engage in discriminatory practices during any interaction.
  • Scrape Data: Extract or harvest data, listings, or personal details using automated bots, scripts, or scrapers without explicit permission.
  • Submit Fraudulent Material: Provide forged, deceptive, or misleading documentation, employment records, or identity proofs prior to or during a session.
  • Distribute Malware: Upload viruses, corrupted data, or software designed to disrupt the platform's infrastructure.

3. User Role Responsibilities

  • Landlords, Vendors & Agents: Must guarantee that property information, legal title status, and pricing shared during sessions are accurate, available, and legally compliant.
  • Tenants, Buyers & Applicants: Must guarantee that all references, proof of funds, mortgage approvals, financial details, and background data provided are authentic.

4. Scope of Service and Final Decisions

  • Professional Guidance: We are qualified property professionals who offer advice and strategic guidance to landlords and vendors with the process of selling or letting their property.
  • Final Responsibility: All final decisions regarding pricing, tenant selection, buyer selection, and contract approvals fall solely and exclusively with the respective landlord or vendor.
  • No Brokerage: PropertyBuddy.ie acts purely as an online intermediary and professional advisory resource. We do not act as a legal party to any tenancy, lease, or property sales agreement.
  • User Due Diligence: Any contract, lease, financial transaction, or booking deposit is undertaken entirely at your own risk. We strongly recommend conducting independent professional physical valuations, surveys, and standard legal conveyancing checks through a qualified solicitor.

5. Third-Party Contractors and Additional Services

  • Intermediary and Booking Agent Role: PropertyBuddy.ie may facilitate bookings, introductions, or arrangements for additional property services provided by third-party contractors (e.g., surveyors, BER assessors, photographers, or legal professionals). For these additional services, PropertyBuddy acts strictly as a booking agent and intermediary.
  • Separate Contracts: When you book a third-party contractor through us, you enter into a direct contractual relationship with that specific service provider. We are not a party to that agreement.
  • No Contractor Liability: PropertyBuddy accepts no responsibility or liability for the quality, safety, legality, timing, or delivery of any work performed by third-party contractors. Any disputes regarding their services must be resolved directly with the contractor involved.

6. Fees, Refunds, and Rescheduling

  • No Refunds Policy: Once a consultation is booked and payment is processed, we do not offer refunds under any circumstances, subject to your statutory rights under Irish consumer law.
  • Complimentary Rescheduling: We allow clients to reschedule their booked consultation once for free.
  • Subsequent Changes: Any additional rescheduling requests beyond the first free instance may be subject to a cancellation fee or require a new booking payment.
  • Third-Party Fees: Fees paid for third-party contractor services are governed by that contractor's individual cancellation and refund policies.
  • Third-Party Processors: We use secure third-party billing providers (e.g., Stripe) to handle financial transactions. We do not store complete financial details on our servers.

7. Intellectual Property

  • Platform Content: All branding, source code, logos, and interface designs on PropertyBuddy.ie belong to us or our licensors and are protected by copyright laws.
  • User Content License: By uploading listings, photographs, or text to the platform during your service setup, you grant PropertyBuddy a non-exclusive, royalty-free, worldwide license to display, host, and distribute that content to provide the service.

8. Termination or Cancellation of Service

  • Our Right to Terminate: We reserve the right to cancel scheduled consultations or refuse service to anyone who violates these terms, engages in fraudulent activity, or acts abusively.
  • No-Shows: If you fail to attend your scheduled consultation without prior rescheduling notice, the session will be marked as completed, and no option to reschedule will be offered.

9. Governing Law and Disputes

  • Jurisdiction: These terms are governed by and construed in accordance with the laws of Ireland.
  • Dispute Resolution: Any formal legal disputes arising from your use of the Platform or consultation service must be brought exclusively before the courts of Ireland.

10. Limitation of Liability

  • Maximum Exclusion: To the maximum extent permitted by Irish law, PropertyBuddy will not be liable for any financial losses, lost deposits, structural property damage, missed rentals, or personal disputes arising from decisions made by users following advice given during consultations, or from the acts and omissions of third-party contractors.

11. Changes to These Terms

We may occasionally update these Terms of Service to reflect shifts in regulatory compliance or platform functionality. We will notify you of substantial updates via email or a prominent notification on our website. Booking a consultation after changes go live constitutes acceptance of the revised terms.12.
